TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions (“T&C”) govern all services provided by Bid2Buy Auctioneers (Pty) Ltd (“Bid2Buy Botswana”) relating to the sale and purchase of goods through auction.

By registering for, bidding in, or consigning goods to any auction, all parties agree to be bound by these T&C and any specific auction terms.

2. General Auction Terms

2.1 Registration and Participation

All bidders must register for each auction. Bid2Buy Botswana may refuse registration or participation on reasonable operational, legal, or compliance grounds.

2.2 Bidding Process

All bids are binding. The highest accepted bid as declared by the auctioneer shall constitute the sale. In the event of a dispute, the auctioneer’s record of sale shall be final, acting in good faith.

2.3 Payment

Successful bidders must pay within the specified timeframe. Failure to pay may result in cancellation of the sale, forfeiture of deposits (where applicable), and resale of the item.

2.4 Collection of Items

Items must be collected within the stated period. Failure to collect may result in storage fees, and Bid2Buy reserves the right to resell or dispose of uncollected items after reasonable notice.

2.5 VAT

All fees and commissions are subject to VAT at the prevailing rate in Botswana.

3. Vehicle Auction Terms

3.1 Seller Fees

Sellers shall pay 8% commission plus VAT on the final sale price.

3.2 Withdrawal of Vehicle

If a vehicle is withdrawn after submission, a fee of P5,000.00 becomes payable.

3.3 Delivery and Risk

Vehicles must be delivered to Bid2Buy premises at the agreed time. Risk remains with the seller until ownership passes to the buyer upon full payment.

3.4 Seller Warranties

Sellers warrant that they are the lawful owners of the vehicle, that it is free of undisclosed encumbrances, and that they have full authority to sell it.

3.5 Indemnification and Insurance

Sellers indemnify Bid2Buy Botswana against claims arising from ownership, legality, financing, or misrepresentation of the vehicle.

Bid2Buy Botswana maintains insurance for risks under its operational control. However, insurance does not reduce or replace the Seller’s obligations.

Bid2Buy Botswana shall be liable only for loss or damage caused by its proven negligence or wilful misconduct.

3.6 False Representation

If misrepresentation is discovered, Bid2Buy may cancel the sale and recover commission and related costs from the seller.

3.7 Required Documents

Sellers must provide all required legal documents including registration papers, identification, and corporate resolutions where applicable.

3.8 Seller Registration Fee

A non-refundable registration fee of P350 plus VAT applies.

3.9 Right to Reject

Bid2Buy reserves the right to reject any vehicle based on reasonable operational, legal, or compliance considerations.

4. Furniture & Small Items Auctions

4.1 Stock Delivery

Clients are responsible for delivering stock to Bid2Buy premises at their own cost.

4.2 Proof of Identity

Clients must provide valid identification when registering goods.

4.3 Goods Received and Reserve Prices

A goods received voucher will be completed upon receipt of stock, and reserve prices will be agreed and signed.

4.4 Commission Fee

A 15% commission plus VAT applies on successful sales.

4.5 Unsold Stock

Unsold stock must be collected or reserve prices reduced after agreed auction cycles.

4.6 Storage Fees

Storage fees of P50 per item per day apply to uncollected stock.

4.7 Payment to Clients

Payments are made within 14 working days after the auction.

4.8 Risk and Liability

Bid2Buy shall take reasonable care of items in its possession but is only liable for loss or damage caused by negligence or wilful misconduct. All statutory consumer rights remain unaffected.

4.9 Delivery and Collection Times

Weekdays: 9:00–13:00 and 14:00–16:00.

5. Real Estate Auctions

Terms and Conditions for real estate auctions will be provided separately.

6. Consumer Protection

These Terms comply with the Consumer Protection Act of Botswana. Nothing in these Terms excludes statutory consumer rights or applicable standards set by the Botswana Bureau of Standards.

7. Disclaimer and Limitation of Liability

Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law.

Bid2Buy Botswana shall not be liable for indirect or consequential damages. Nothing in these Terms excludes liability for fraud, wilful misconduct, or negligence where such exclusion is not permitted by law.

8. Governing Law

These Terms are governed by the laws of Botswana.

9. Amendments

Bid2Buy Botswana may amend these Terms at any time. Changes will apply only to future transactions and will be communicated through official channels.
